This translation is for information only. The legally binding text is the German general terms and conditions (AGB).

Last updated: October 2026

§ 1 Scope

(1) These general terms and conditions (“terms”) apply to all contracts for the supply of carpets and fitted carpeting and related services (e.g. consultation, measuring, installation) between

(“supplier”) and the customer, in particular following enquiries via the websites moschee-teppich.de, cami-halisi.de, mosque-carpet.com and tapisdemosquee.fr.

(2) Our offer is aimed exclusively at mosque communities, associations, foundations, other institutions and businesses, not at consumers within the meaning of § 13 of the German Civil Code (BGB). By placing an order, the customer confirms that it is not acting as a consumer.

(3) Deviating terms of the customer apply only if the supplier expressly agrees to them in writing. Individual agreements in the quote or order confirmation take precedence over these terms.

§ 2 Enquiry, quote and conclusion of contract

(1) The information on the website and enquiries submitted via the enquiry form are non-binding. Based on the enquiry, the supplier prepares a written quote (by email or in text form, e.g. via WhatsApp).

(2) The quote is valid for the period stated in it, or for 30 days if no period is stated. Prices and specifications are based on the information provided by the customer; if a later measurement shows different dimensions or conditions, the supplier adjusts the quote accordingly.

(3) The contract is concluded when the customer accepts the quote in text form and the supplier confirms the order in text form (order confirmation).

(4) Anyone placing an order on behalf of a community, association or institution warrants that they are authorised to do so.

§ 3 Prices and payment

(1) The prices stated in the quote apply. They include German statutory VAT (currently 19 %) unless the quote expressly states otherwise.

(2) The amount of the down payment and the payment dates are set out in the quote or order confirmation. The order with the manufacturer is placed and production begins only after the agreed down payment has been received and production approval (§ 4) has been given.

(3) Unless otherwise agreed, invoices are payable without deduction within 14 days of the invoice date.

(4) Donations or sponsorship amounts collected by a community to finance the purchase are received and managed exclusively by the community. The customer alone is the supplier’s contractual partner and the party obliged to pay.

§ 4 Production approval, dimensions and colours

(1) Mosque carpets are made individually to the customer’s specifications. Before production begins, the supplier sends the customer the relevant specifications (in particular dimensions, qibla direction, design, colours, material). The customer checks them carefully and gives production approval in text form.

(2) The customer is responsible for dimensions, room geometry, qibla direction and other information that it provides or approves itself. After production approval, changes are possible only as far as production allows; the customer bears any additional costs.

(3) Deviations that are customary in the trade and in manufacturing are deemed to be in accordance with the contract, in particular slight colour differences compared with screen displays, samples or earlier deliveries, and slight deviations in size that do not impair the intended use.

§ 5 Delivery and dates

(1) Delivery and completion dates are binding only if they are expressly designated as binding in the order confirmation. Other dates are estimates.

(2) Delivery periods begin at the earliest when the agreed down payment and production approval have been received. Delays caused by force majeure or by disruptions at the manufacturer or in the supply chain for which the supplier is not responsible extend agreed periods by a reasonable time; the supplier informs the customer without delay.

(3) Delivery is made to the agreed delivery address. The customer ensures that delivery (access, contact person, unloading point) is possible on the agreed date. The customer bears the costs of a failed delivery for which it is responsible.

(4) On delivery, the customer inspects the goods for visible transport damage and notes any damage on the delivery note. In addition, § 377 of the German Commercial Code (HGB) applies if the customer is a merchant.

§ 6 Installation and acceptance

(1) If installation is part of the order, it is carried out by the supplier or by specialist companies commissioned by the supplier.

(2) The customer ensures that on the agreed date the room is cleared, accessible, heated and supplied with electricity, and that the subfloor is dry, level, load-bearing and free of residues. The supplier may charge reasonable remuneration for subfloor preparation not included in the quote and for waiting times and additional work for which the customer is responsible.

(3) After installation is complete, acceptance takes place together with a representative of the customer; the result is recorded in an acceptance report. Insignificant defects do not entitle the customer to refuse acceptance. If the customer starts using the work without reporting defects, it is deemed accepted.

§ 7 Retention of title

The goods delivered remain the property of the supplier until all claims under the contract have been paid in full.

§ 8 Warranty

(1) The statutory rights in respect of defects apply with the following provisions: the supplier first provides subsequent performance, at its choice, by repair or replacement.

(2) Claims for defects in goods delivered become time-barred one year after delivery. This does not apply to claims for damages under § 9, to fraudulently concealed defects or to claims for which the law provides a longer period for buildings (§ 438 (1) no. 2 and § 634a (1) no. 2 BGB, in particular for permanently installed fitted carpeting); in these cases the statutory periods apply.

(3) The following in particular are not defects: deviations under § 4 (3), normal wear and tear, and damage caused by improper use, cleaning or care, moisture from the subfloor or structural conditions for which the supplier is not responsible.

§ 9 Liability

(1) The supplier is liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.

(2) In cases of slight negligence, the supplier is liable only for breach of essential contractual obligations, i.e. obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment the customer may regularly rely. In this case, liability is limited to the foreseeable damage typical for this type of contract.

§ 10 Applicable law, place of jurisdiction, final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is the supplier’s registered place of business.

(3) Should individual provisions of these terms be or become invalid, the validity of the remaining provisions remains unaffected.

(4) The language of the contract is German. Translations are for information only.
